CONDITION OF ITEMS

We sell many customized items. If you have any questions or concerns about a piece and its condition, please contact us for additional photos and details prior to purchase.

All CHICLUSSO products carry a one (1) year warranty unless otherwise specified. Valid from the date of delivery or pick-up. The warranty applies to manufacturing defects resulting from residential use only. Our products are not intended for commercial nor industrial use. This guarantee does not cover normal wear and tear such as but not limited to: cuts, scratches, damage caused by impact or accidents, discoloration, shrinkage, fabric pilling, misshapen filling materials and stains.

Products that have been stored, assembled or installed incorrectly, used inappropriately, abused, misused, altered, or cleaned using the wrong cleaning methods and/or cleaning products, are not covered by this guarantee. This guarantee does not apply if the product has been placed outdoors or in a harsh environment. This guarantee does not cover consequential or incidental damage. The original receipt is required for all claims and is non-transferrable.

Goods requiring assembly need special care when handling. Inspect all parts and hardware BEFORE assembly. Valid part and/or hardware claims must be made PRIOR to assembly. Damages resulting from assembly errors and/or mishandling of parts, most notably scratches, are not covered by this guarantee.

You may have consumer rights under applicable federal and or local law that supersede aspects of this warranty. This warranty does not, in any way, supersede the rights given to you by law. As such, these exclusions or limitations may not apply to you.

Listed pricing for any item purchased online or in the showroom does not include shipping, packaging or delivery unless otherwise noted.

RETURNS

All Sales Are Final. If you have any hesitation prior to purchase or would like more details, we would love to share more photos and answer any questions!  You can also contact us for a showroom visit, where you can have a close look at the furniture pieces we currently have on stock.

If you are not completely satisfied with the non-customized items in your purchase due to the defects and quality issues, please contact us to return or exchange your item(s) within 7 days of the delivery date, with proof of purchase.

Any returns due to customer preference after the order is confirmed and delivered, the according refunds will be issued in the form of store credit, and the customers will be charged a flat fee of $99.00 for delivery.

Note that returns or exchanges are not accepted for customized items, items that have been installed, mattresses and/or foundations no longer in their original packaging, and other items listed below. Other exclusions may apply. 

Upon receiving the products, if the clients found defects due to manufacture or delivery, please contact the seller within 7 days after the delivery date. We do not accept any return or exchange after 7 days of the delivery date. All returns should be in the original package.

Upon return, your item will be inspected, and exchanges, credits or refunds will be issued for the purchase price. Any taxes charged will be refunded in accordance with applicable laws. Delivery fees are non-refundable with the exception of manufacturer defects or transit damage. CHICLUSSO reserves the right to refuse returns or exchanges of items that are not in as-new condition due to damage or misuse by the client.

CUSTOMIZED ITEMS

Orders of customized items are submitted for production immediately upon order placement and are built to your specifications. A non-refundable 50% deposit will be taken when the order is placed; the remaining 50% will be charged when your order ships. If you choose to cancel your order(s) for customized item(s) prior to delivery, your 50% deposit will not be refunded.

Note that returns or exchanges are not accepted for customized items. Once delivered, customized-item order returns or exchanges due to customer preference or any other reason cannot be accepted.

For customized items, any returns or exchanges due to the defects or quality issues of the products, shall be claimed within 7 days of the delivery date. Upon return, your item will be inspected, and exchanges, credits or refunds will be issued for the purchase price.

Orders of customized items are submitted for production immediately upon order placement, before sending the order for production, the client needs to sign the drawings for customized products to confirm. We do not accept any returns or exchanges for customized products with the exclusion of defects due to quality issue or delivery.

For customized items, any returns will be issued in the form of store credit.

PRODUCT DISPLAY

CHICLUSSO endeavors to display the products and other images on our site as accurately as possible. However, since we cannot control the capabilities and limitations of your monitor, we do not guarantee that your monitor’s display of any color, texture or detail of any actual merchandise will be accurate.

Colors are not guaranteed. Due to color variability in computer and screen monitors, we have no liability if colors of the products do not match their display on the site. We reserve the right to change and discontinue products at any time without notice to you.

All material, including the text, pictures and references on our website is provided “as is.” To the fullest extent permitted by law, we disclaim all representations and warranties, expressed or implied, with respect to such material, including, but not limited to, the warranties or merchandise, suitability of said merchandise for a particular purpose, title, non-infringement and freedom from computer virus, and all warranties which may be implied from course of conduct or course of dealing. We do not guarantee that information contained on this site is accurate, complete, or current. All products and prices are subject to change without notice.

FREIGHT & DELIVERY CLAIMS

CHICLUSSO is not liable for damages that occur during transit or for storage. All products are carefully inspected by our expert staff and are in perfect condition prior to shipping.  The carrier assumes all responsibility upon acceptance of products. All shipments should be opened and inspected immediately upon receipt.

Claims for damages, shortages or overcharges should be placed with delivering carrier by the buyer or receiver of goods. It is the customer’s responsibility to inspect all products upon receipt and file ANY and ALL and claims with the carrier.

Do not accept the shipment until all shortages and carton damage are noted on both the bill of lading and the freight bill. Concealed damage must be reported to the carrier within 7 days of receipt. While reporting misconduct and damage that are caused from the delivery, please take photos and other similar methods to keep evidence of that damage, and contact carrier as soon as possible within 7 days.

Failure to make claims shall constitute acceptance of the products and waiver any claims of defects, errors or shortages. Hold product/packaging for carrier’s inspection.

WOOD AND WOOD FINISHES

CHICLUSSO handcrafted furniture is made of solid woods and wood veneers and each piece is custom made. Natural wood expands and contracts as moisture in atmospheric surroundings changes. Some woods may crack due to drastic temperature and climate changes. While this is a very rare occurrence, CHICLUSSO cannot control nor will be held responsible for these forces of nature. 

CHICLUSSO is also not responsible for the wear and tear to furniture due to everyday use. Each piece of CHICLUSSO fine wood furniture is finished by hand and involves many steps. The result is a beautiful and unique piece. Wood has grain and color variations due to the growth pattern of each tree. Due to theses variations and the process by which we hand finish each piece, finishes on individual pieces will not necessarily match. The finishes shown on our website have been reproduced as accurately as possible.

MISCELLANEOUS

CHICLUSSO reserves the right to terminate your access to this site or any part of it in the event you violate any agreement or obligation you may have with us, or if you have engaged in any conduct which may violate applicable law or be harmful to us or our property or any third party or its property.

SHIPPING & HANDLING

ChicLusso Studio & Boutique Ltd.  provides Shipping + Delivery services through Canada. Canada-wide Shipping outside Great Vancouver Area quotes may take several days to obtain from our partners.

ChicLusso Studio & Boutique Ltd. contracts Third Party Delivery Providers for White Glove Delivery services.

By Completing a Purchase through ChicLusso Studio & Boutique Ltd.  you acknowledge that responsibility of your purchase transfers to the Third-Party delivery provider of your choice at the time of pickup.

LOCAL DELIVERY

ChicLusso Studio & Boutique Ltd. can provide local delivery in the Vancouver and surrounding areas through Third Party Delivery Providers; rates begin at $70.  Local courier services are also available for smaller and medium sized goods. Delivery Invoices must be paid prior to the item going out for Delivery.  Responsibility of the goods transfers to the Delivery provider at the time of pickup from our showroom. If expedited delivery is needed, rates may vary.

FED EX + UPS SHIPPING 

Items that are eligible for shipping via UPS or FedEx will be mailed within 5 days of payment. Items will be insured and will be shipped as Signature Required upon Delivery, unless otherwise noted by the customer.

Please understand that delays in shipments via Canada Post, Fed Ex or UPS are not the fault of ChicLusso Studio & Boutique Ltd. If you would like to ensure an item arrives by a certain date, we will assist with expedited delivery. 

Items that are returned to us due to lack of signature upon arrival or incorrect delivery addresses, will be re-charged a shipping fee in order to re-ship. Items that are lost in the mail or stolen following delivery are not the responsibility of ChicLusso Studio & Boutique Ltd., nor can we be held liable for replacing the item. We will happily assist in filing a claim with the Mail Provider. Clients are responsible for any insurance deductibles involved in an insurance claim.

LOCAL PICKUP

Goods purchased locally are available for pickup from our showroom or warehouse and must be picked up in 7 days from the commitment of the sale, less otherwise agreed upon.

Pick up hours are Tuesday – Friday 11-6pm and Saturday, 11-5pm. Purchased items left at ChicLusso Studio & Boutique Ltd. over 7 business days without payment for additional services will be assessed a daily storage fee of $10 per item per day, billable upon pickup.

Items left over 30 Calendar days will become the property of ChicLusso Studio & Boutique Ltd., with no credits or refunds issued.  Customers take responsibility for item condition at the point of pick-up

ADDITIONAL TERMS + DAMAGED GOODS

ChicLusso Studio & Boutique Ltd. is not responsible for damage, theft, loss or otherwise that occurs after the item has been purchased.  ChicLusso Studio & Boutique Ltd. is not responsible for damage, theft, loss or otherwise that occurs as a result of shipping or White Glove Delivery. ChicLusso Studio & Boutique Ltd. is not responsible to refund, restore or replace inventory that may experience damage, theft, loss or otherwise as a result of White Glove Shipping, Ground Shipping through Fed Ex, UPS or Canada Post, Local Third Party Delivery Providers or ChicLusso Studio & Boutique Ltd. staff assisting with load in or pick up. ChicLusso Studio & Boutique Ltd. will assist in coordinating shipping as a service to our clients but the Third Party Delivery Providers bear full responsibility for the items. By completing a purchase, the client is responsibility for any insurance deductibles related to filing an insurance claim.

If using a third-party receiver, clients acknowledge the receiving party takes full responsibility for the condition of pieces at the point of delivery if no defects are documented directly with the carrier. On request, customers may also coordinate their own shipping directly with the carrier of their choice by making all arrangements for pick-up and packaging requirements. Carriers arranged by customers take responsibility for item condition at the point of purchase.

We suggest that all clients fully inspect their item at the time of delivery and before the delivery providers leave the home. In the rare event that an item arrives damaged, please call our showroom immediately so we can begin the claim process. In order for us to assist in a resolution and file a claim, we will need to receive detailed photos within 24 hours. Please also take photos of the damage and shipping material and keep the original shipping packaging. ChicLusso Studio & Boutique Ltd. will file a formal claim with the Third-Party White Glove Delivery Provider. ChicLusso Studio & Boutique Ltd. is not responsible to provide refunds for goods damaged, lost or stolen by Third Party Providers.
